Terms of Service

1. Acceptance of Terms

By accessing and using Manufact ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

By creating an account or signing in, you expressly agree to these Terms of Service, including our use of analytics and tracking technologies (such as cookies, session recording, and product analytics) to improve the Service. This constitutes your consent to such tracking as described in our Privacy Policy.

2. Description of Service

Manufact provides a cloud platform for the Model Context Protocol (MCP) ecosystem. Our service includes:

  • MCP server hosting and deployment from GitHub (with CI/CD, custom domains, observability)
  • MCP agent management and AI agent builder
  • MCP Apps and interactive widgets for ChatGPT and Claude
  • Inspector for debugging and testing MCP servers
  • Workflow builder for visual orchestration
  • Gateway and tunnel for MCP server connections
  • Server registry and templates

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful or malicious code
  • Deploy or run MCP servers that are malicious, abusive, or otherwise violate acceptable use
  • Abuse third-party API connections (e.g., LLM providers) through the platform
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal or unauthorized purpose

5. AI and LLM Services

The Service may integrate with third-party AI and LLM providers. You are responsible for your own API keys and any costs associated with third-party services. Manufact makes no warranties about the quality, accuracy, or suitability of AI-generated outputs. You are responsible for all content processed through MCP servers you deploy or connect to the platform.

6. MCP Server Content

You are responsible for all code and content you deploy to Manufact. Manufact may suspend or remove servers that violate these Terms or acceptable use, without prior notice.

7. Plans and Billing

The Hobby plan is free. The Business plan is offered at custom pricing and is negotiated separately. Manufact reserves the right to modify plan limits, features, and pricing. Billing for paid plans is handled outside the platform (e.g., via invoice or sales agreement).

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Manufact and its licensors. The Service is protected by copyright, trademark, and other laws.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, you may request export or deletion of your data within 30 days. After that period, we may delete your data in accordance with our data retention policy.

11. Disclaimer

The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, Manufact excludes all representations, warranties, conditions and terms relating to our Service and the use of this Service, including any warranties regarding AI or LLM outputs.

12. Limitation of Liability

In no event shall Manufact, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service, including any AI or LLM outputs, third-party API usage, or content processed through MCP servers.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Delaware.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
